1 GENERAL
Capitalised words used in these Booking Conditions shall, unless the context otherwise requires, have the following meanings:
1.1. The Client: The key contact of the group of guests booking to stay at Wadhurst Castle Cottages;
1.2. The Estate: S.P FitzGerald and N. Clough as Trustees of the FitzGerald Family Trusts and S. P FitzGerald on her own behalf;
1.3. The Booking Period: the period of time that the Client has booked to stay at Wadhurst Castle Cottages
1.4. The Booking Fee: the cost of hiring one of the Estate Properties for the Booking Period;
1.5. The Estate Properties – Wadhurst Castle Cottages:
Castle Cottage, Wadhurst Castle, Wadhurst, East Sussex TN5 6DA
Goldcrest Lodge, Castle Keep, Wadhurst, East Sussex TN5 6AH
Tawny Owl Lodge, Castle Keep, Wadhurst, East Sussex TN5 6AH
1.6. The Dog Surcharge: £25 per dog, per stay – maximum 2 dogs. No other pets permitted
1.7. The Security Deposit:
£100, Castle Cottage
£50, Goldcrest Lodge and Tawny Owl Lodge
2. BOOKINGS
2.1. Reservations may be made in two ways:
(1) initially by email or telephone or
(2) directly online using the “book now” button on the website
2.2. For reservations made by email or telephone:
(a) the Estate will allocate the relevant Estate Property, if available, to the Client during the Booking Period for a period of 5 working days in order to give the Client time to return the Booking Form and Deposit to the Estate.
(b) If the Estate does not receive the Booking Form and Deposit within 5 working days of the Client’s initial reservation, the Estate shall be free to allocate the property to another person during the Booking Period
2.3. By returning the Booking Form and Deposit or completing the online Booking process, the Client confirms that they are authorised by all members of the Group to make this Booking subject to the Booking Conditions and to make payment on behalf of the Group.
2.4. All reservations are provisional until confirmed in writing or by email by the Estate. No contract exists for the hire of the Estate Properties until the Estate has received and accepted the Client’s Booking Form or the online booking together with the Deposit and the Client has received Confirmation of Booking by post or by email to the address or email address the Client has given. Once the Estate does so, there is a binding legal contract between the Client and the Estate. The Estate is under no obligation to accept any Booking.
2.5. The Estate will endeavour to accommodate reasonable requests to amend Bookings. where such requests are made more than 8 weeks prior to the Start Date. However, the Estate cannot guarantee that such requests will be met. Where the Estate is able to amend a Booking, the Estate reserves the right to charge a Booking Amendment Fee not exceeding £35.
2.6. The contract is subject to the Client’s right of cancellation (see clause 5.1).
2.7. The Estate may change these Booking Conditions without notice to the Client in relation to future Bookings.
3. DEPOSITS AND PAYMENTS
3.1. The Estate requires payment of a non-refundable Deposit (subject to clause 5.1 below) to be paid either on receipt of an invoice or when using the “Book Now” button on the website. The Client will be notified of the amount of the Deposit and the Booking Fee when making a reservation. The Deposit will usually be 25% of the Booking Fee or the full amount if the Booking is less than 8 weeks away.
3.2. The Booking Fee will be payable in full 8 weeks prior to the Start Date. The Estate will accept payment by cheque made payable to “S P FitzGerald”, by BACS or by credit/debit cards. If full payment has not been received by the date which is not less than 6 weeks prior to the Start Date, the Estate reserves the right to cancel the Booking and allocate the Estate Property to another person during the Booking Period (in which case the Client will also forfeit all of the Deposit).
4. DAMAGE AND SECURITY DEPOSIT
4.1. The Estate reserves the right to require payment of a Security Deposit in addition to the Deposit and Booking Fee. Such payment will be requested in the Confirmation of Booking Form and will be payable at the same time as the final part of the Booking Fee. The Security Deposit will be reimbursed via BACS payment within 2 weeks of the last day of the Booking Period less any deductions made in accordance with clause 4.3 below.
4.2. There will be kept at each of the Estate Properties an Inventory of items which are available for personal use at the property during the Booking Period. It is assumed that all items are in reasonable condition and fit for purpose. Unless the Client notifies the Estate of any discrepancies within 24 hours of arrival at the Estate Property the Client will be deemed to have accepted that the Inventory is complete and accurate.
4.3. The Client is responsible for taking reasonable care of the Estate Property and all its contents throughout the Booking Period ensuring that they are kept in the same condition and repair as found on arrival. The Client should notify the Estate of any loss or damage as soon as possible and, in any event, before the End Date. Whilst the Estate will not usually require compensation in respect of minor damage or breakages, the Client will indemnify the Estate on demand in respect of any loss or damage or any subsequent cost to the Estate arising from such loss or damage (such as cleaning and repair costs) which occurs as a result of any actions or omissions of the Client or any member of the Group during the Booking Period. The Client acknowledges that in certain circumstances third parties, authorised by the Estate, may need to enter the property during the Booking Period in order to assess and/or repair or make good any damage or to replace broken items.
5. CANCELLATION
5.1. The Client has the right to cancel the Booking at any time up to the end of 7 working days after the Client receives the Confirmation of Booking Form unless the Start Date is before the end of the 7 working day cancellation period. A working day is any day other than weekends and bank or other public holidays.
5.2. To exercise the right of cancellation, the Client must give written notice to the Estate by hand, post, or email, at the address, or email address shown below, including a copy of the Booking Form.
5.3. The Estate will refund the Client any sum that has been paid by the Client in relation to the cancelled Booking within 30 days of receiving the notice of cancellation.
5.4. If the Client wishes to cancel the Booking after the period set out in clause 5.1 above, the Client should inform the Estate immediately. The Client remains liable to the Estate for the full Booking Fee and Deposit unless the Estate is able to re-let the property during the whole or part of the Booking Period in which event the Estate will refund to the Client 75% of any fee received for the re-letting of the property (which may have been re-let at a discount) less a reasonable charge for administration costs (not to exceed £35).
5.5. The Estate strongly recommends that the Client takes out cancellation insurance.
5.6. In the unlikely event that the Estate is unable to honour the Booking due to events outside its control (including, but not limited to, anticipated prolonged interruption or failure of utility services (including, but not limited to electric power, gas or water), damage or destruction by fire, flood or other cause (whether natural or man-made)) the Estate will notify the Client by post or by e-mail as soon as possible and will refund the Client all monies paid to the Estate. Upon receipt of a full refund, the Client will have no further claim against the Estate.
5.7. The Estate reserves the right to refuse entry or to terminate the Booking early if any information the Client has provided on the Booking Form is found to be false, incomplete or inaccurate.
6. LIMIT OF LIABILITY
6.1. The Estate has made every effort to ensure the accuracy of information provided to the Client. All property description and pricing information on the website is given in good faith and is believed to be correct at the time of publication. The Client is advised to discuss specific requirements and to check relevant details with the Estate before returning the Booking Form as the Estate cannot be held liable for any errors or the results of such errors.
6.2. The Client must take all reasonable steps to ensure the personal safety of the Group and any visitors to the Estate Property during the Booking Period and to safeguard all personal belongings. The Client acknowledges that the use of the property is entirely at the Client’s own risk. The Estate accepts no responsibility for injury, loss or damage to personal belongings. This does not affect the Client’s statutory rights.
6.3. The Estate will not be liable to the Client or any visitor to the Estate Property during the Booking Period for any matters outside its reasonable control or which were not reasonably foreseeable, including but not limited to the failure of domestic appliances, interruption or failure of utility services (including, but not limited to electric power, gas or water), plumbing, electrical wiring, drainage, sewerage or damage due to exceptional weather conditions.
6.4. Please note that the Estate cannot guarantee a continuous uninterrupted supply of electricity, gas or water to the properties. In the event of failure please contact Fiona.
7. TERMS OF USE OF WADHURST CASTLE COTTAGES
7.1. The Estate Properties are available from 3 pm on the Start Date and must be vacated by 10 am on the End Date.
7.2. If the Client’s arrival is to be delayed beyond 7 pm on the Start Date, the Client must contact the Estate to confirm access arrangements. If the Client fails to do so, the Client may not be able to access the Estate Property.
7.3. The Estate has the right to refuse admittance without refund if in its sole and absolute discretion the Estate reasonably believes that damage to the Estate Property or its contents is likely to be caused or is being caused by the Client or any member of the Group.
7.4. The Estate reserves the right to terminate the Booking Period early, without notice and without refund if any of these Terms of Use are broken.
7.5. If the Estate Property is not vacated by 10 am on the End Date and the Client has not previously agreed an extension with the Estate and/or paid the additional Booking Fee required by the Estate, the Estate will inform the relevant authorities and take steps to remove the Group from the premises. The Client will be liable to reimburse the Estate in full for all costs it incurs in this regard and to pay the Estate for the additional period spent at the premises.
7.6. Smoking is not permitted in the Estate Properties. Smoking is permitted in the Castle Cottage garden and on the decking of Goldcrest Lodge and Tawny Owl Lodge. Sand-filled pots are provided as ash trays.
7.7. Vehicles must be parked only in the areas designated for this purpose.
7.8. The décor of the Estate Properties must not be damaged in any way. The Client must ensure that all delicate surfaces are respected and that no nails, pins, sticky tape, blu-tack etc is used to affix items to the Estate Properties.
7.9. The contract is for the hire of the Estate Property outlined in the Booking Form for holiday purposes only. The Group will not use the Estate Property for any commercial purposes or for any activity which may cause a nuisance or annoyance to neighbours of the property, including, but not limited to, occupiers of or visitors to the Castle.
8. COMPLAINTS
8.1. If the Client has any complaint in relation to the Estate Properties during the Booking Period the Client should contact the person nominated for this purpose by the Estate who will use all reasonable endeavours to resolve any issues. Any complaints the Client wishes to make after the End Date should be made as soon as possible in writing to the Estate at the address, or email address shown below.
8.2. If the Client has any complaint in relation to the service the Client has received in relation to the Booking, the Client should notify the Estate in writing as soon as possible at the address, or email address shown below.
9. DATA PROTECTION
9.1. The Estate will take all reasonable precautions to keep the details of the Client’s order [and payment] secure, but, unless the Estate is negligent, the Estate will not be liable for unauthorised access to information supplied by the Client.
9.2. The Estate will only use personal information the Client provides for the purpose of fulfilling the Booking and to notify the Client of products and offers that may be of interest from time to time, unless the Client agrees otherwise.
9.3. By accepting these terms and conditions the Client is indicating consent to receiving these communications from the Estate unless the Client informs us otherwise, which can be done at the point of booking on the Booking Form. If at any time the Client would like the Client’s details to be removed from this list, this can done by clicking the unsubscribe link on any of the emails or by contacting the Estate on stay@wadhurstcastlecottages.co.uk and it will be removed from the database. Our Cookie Policy and Privacy Policy can be found on our website.
10. APPLICABLE LAW AND OTHER GENERAL CONDITIONS
10.1. These Booking Conditions will be subject to English law and the English courts will have exclusive jurisdiction in respect of any dispute arising out of the Booking.
10.2. These Booking Conditions together with the Booking Confirmation Form constitute the entire agreement and understanding between the Client and the Estate in relation to the hire of the Estate Properties. The Client acknowledges that in entering into this contract the Client has not relied upon any representations, warranty, collateral contract or other assurance except for those set out in these Booking Conditions.
10.3. No variation of the agreement between the Client and the Estate shall be effective unless made in writing and signed by each of the parties hereto. The agreement reached between the Client and the Estate is personal to those parties and cannot be reassigned. A person who is not a party to these Booking Conditions shall not have any rights under or in connection with it.
11. PETS
One large or two small dogs are permitted by prior arrangement and must be booked and paid for in advance (£25 per dog per stay) – STRICTLY NO OTHER PETS. It is necessary that clients bringing dog(s) agree to the following conditions.

House Rules for Dogs
- You need to let us know in advance if you are intending to bring your dog(s) (one large or two small). All dogs must be booked in by prior agreement at a charge of £25 per dog per stay.
- Dogs must be clean before entering the Estate Property – we do provide a dog towel.
- Dogs are not permitted on any furniture, ie. sofas and beds – even with covers applied
- In Castle Cottage, dogs are not permitted upstairs. There is a stair gate available
- Your dog(s) must not be allowed to cause any kind of nuisance to the neighbouring properties and should not be left alone in the Estate Property.
- Your dog(s) must be at least 1 year old at the time of your holiday
- Please do not allow your dog(s) to use the lawns as toilets or the grass will spoil.
- Please clean up after your dog(s) in the garden, car park and driveway. Poo bags are provided in all Estate Properties and a poo bin is situated outside the properties
- Dogs should be kept on a lead until you reach the woods. There are sheep in the fields so please ensure that all gates are shut after you. Electric fencing may be on, so do be aware when walking through gateways
- The interior and grounds of the property must be left in a clean, undamaged condition.
- Please give the Estate Property a basic clean and remove as much of the dog hair as possible; if the property requires serious additional cleaning a £50 fee will be charged to cover the cost.
- The Castle Cottage garden is gated and dog secure. Goldcrest Lodge and Tawny Owl Lodge have a gated decking area which is dog secure.
- There are some lovely walks in the area. As well as round the Wadhurst Castle Estate, we are close to many footpaths. Maps of local walks can be found inside the Estate Property.Bewl Water and Bedgebury Forest are perfect places to take your dogs. The South Downs and Camber Sands are only ¾ hour drive away.
